This Privacy Policy explains how Elevex Studio collects, uses, discloses, and protects personal information in accordance with the Privacy Act 1988 (Cth) (“Privacy Act”) and the Australian Privacy Principles (“APPs”) contained in Schedule 1 of the Privacy Act. By engaging our services, submitting an enquiry, or visiting our website, you acknowledge that you have read and understood this Privacy Policy.
1. Scope and Application
1.1 This Privacy Policy applies to all personal information collected by Ryan Patrick Telley trading as Elevex Studio (referred to as “we”, “us”, or “Elevex”) in connection with our website design, development, and maintenance services.
1.2 This Policy applies to clients, prospective clients, website visitors, and any other individuals whose personal information we handle.
1.3 Elevex Studio is a sole trader and is not a registered APP entity with an annual turnover exceeding $3 million. However, we voluntarily comply with the Australian Privacy Principles as a matter of best practice and professional obligation to our clients.
2. What Personal Information We Collect
We may collect the following categories of personal information:
2.1 Identity Information: Full name, business name, ABN or business registration details.
2.2 Contact Information: Email address, phone number, postal address, website URL.
2.3 Project Information: Business goals, brand assets, written content, images, design preferences, and other materials provided to us for the purpose of delivering web design services.
2.4 Financial Information: Invoice records, payment references. We do not collect or store credit card numbers, bank account credentials, or payment processing data. Bank transfers are made directly by the client to our nominated account.
2.5 Communications: Email correspondence, enquiry form submissions, and any other communications you send to us.
2.6 Website Usage Data: If you visit elevex.biz, we may collect standard web server logs including IP addresses, browser type, referring pages, and pages visited, for the purpose of website security and performance monitoring. This data is not used to identify individual users.
3. How We Collect Personal Information
3.1 We collect personal information directly from you when you: (a) complete and submit a Project Brief or contact form; (b) contact us by email or phone; (c) enter into a Client Agreement or Maintenance Agreement with us; (d) visit our website at elevex.biz.
3.2 We do not collect personal information from third parties without your consent, except where you have authorised us to liaise with third-party providers (such as domain registrars or hosting platforms) on your behalf.
3.3 We will always collect personal information by lawful and fair means, and we will not collect information by means that are unreasonably intrusive.
4. Why We Collect Personal Information
We collect personal information for the following primary purposes:
4.1 To provide and deliver our web design, development, and maintenance services to you.
4.2 To communicate with you about your project, including issuing quotes, agreements, invoices, and project updates.
4.3 To manage our business relationship with you, including record-keeping for invoicing and tax purposes under applicable Australian taxation law.
4.4 To comply with our legal obligations, including obligations under Australian tax law, contract law, and any applicable court or tribunal order.
4.5 We will not use your personal information for a purpose other than the primary purpose of collection unless: (a) you have consented; (b) a secondary use is directly related to the primary purpose and you would reasonably expect it; or (c) it is required or authorised by law.
5. Disclosure of Personal Information
5.1 We do not sell, rent, trade, or otherwise transfer your personal information to third parties for marketing or commercial purposes.
5.2 We may disclose personal information to the following categories of recipients only where necessary to deliver our services: (a) Hosting and domain service providers, for the purpose of publishing and managing your website. (b) Payment processors or financial institutions, to the extent necessary to process or reconcile payments. (c) Professional advisers, including legal and accounting professionals, who are bound by equivalent confidentiality obligations.
5.3 We may disclose personal information where required or permitted by law, including to comply with a court order, subpoena, regulatory requirement, or law enforcement request.
5.4 We do not disclose personal information to recipients outside of Australia unless: (a) you have consented; (b) the overseas recipient is subject to a law or binding scheme that provides substantially similar privacy protections to the APPs; or (c) we are required by law to do so.
6. Storage and Security of Personal Information
6.1 We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, and disclosure. These steps include: (a) using password-protected devices and accounts; (b) storing files in access-controlled environments; (c) using encrypted email and secure file transfer where practicable.
6.2 While we take reasonable precautions, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security and are not liable for breaches that are outside our reasonable control.
6.3 We retain personal information only for as long as it is needed for the purpose for which it was collected, or as required by law. Client records, including agreements and invoices, are retained for a minimum of 5 years in accordance with ATO record-keeping requirements. After this period, information is securely deleted or de-identified.
7. Access to and Correction of Personal Information
7.1 You have the right to request access to the personal information we hold about you (Australian Privacy Principle 12). We will respond to such requests within 30 days.
7.2 You have the right to request correction of any personal information we hold that is inaccurate, out of date, incomplete, irrelevant, or misleading (Australian Privacy Principle 13).
7.3 To make an access or correction request, please contact us at hello@elevex.biz. We will verify your identity before providing access. We will not charge a fee for making a request, but may charge a reasonable cost recovery fee for providing access to complex records.
7.4 We may decline access or correction requests in limited circumstances permitted by the Privacy Act.
8. Cookies and Website Analytics
8.1 Our website at elevex.biz may use cookies or similar tracking technologies for the purpose of website functionality and basic analytics (e.g. visitor numbers, page views). Cookies do not collect personally identifiable information.
8.2 You may disable cookies in your browser settings. Doing so may affect some website functionality.
8.3 We do not use third-party advertising or behavioural tracking technologies on our website.
9. Direct Marketing

10.2 We will acknowledge your complaint within 5 business days and endeavour to resolve it within 30 days.
10.3 If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or by calling 1300 363 992.

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. Continued use of our services following any update constitutes acceptance of the revised Policy.
