These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. By using the Website, you submit to the non-exclusive jurisdiction of the courts of New South Wales.

2.1 The Website is an informational and marketing platform for Elevex Studio's web design and development services. It is not an e-commerce platform — no goods or services are purchased directly through the Website, and all engagements are formalised through a separate Quote and Client Agreement.

2.2 The Website may include information about our services, pricing indications, portfolio examples, and contact forms or enquiry tools.

3.1 You agree to use the Website only for lawful purposes. You must not: (a) attempt to gain unauthorised access to the Website or any connected systems; (b) introduce viruses, malware, or any other harmful code; (c) use automated systems (bots, scrapers) to extract data from the Website without prior written consent; (d) impersonate any person or misrepresent your affiliation with any person or entity; (e) use the Website in any way that could damage, disable, or impair its operation.

3.2 We reserve the right to restrict or block access to the Website for any user who breaches these Terms, without notice.

4.1 All content on the Website — including text, graphics, logos, design elements, code, and images — is owned by or licensed to Ryan Patrick Telley trading as Elevex Studio, unless otherwise indicated, and is protected under the Copyright Act 1968 (Cth) and other applicable intellectual property laws.

4.2 You may view and download Website content for personal, non-commercial reference only. You must not reproduce, distribute, modify, or create derivative works from Website content without our prior written consent.

4.3 Portfolio items displayed on the Website showcase work completed for clients under the portfolio usage rights granted in the relevant Client Agreement, or are concept/demonstration projects as labelled. If you are a featured client and wish to request removal, contact hello@elevex.biz.

4.4 “Elevex” and “Elevex Studio” are business names associated with Ryan Patrick Telley (ABN: 27 958 310 326). Unauthorised use of these names or associated branding is prohibited.

Website code, design systems, and technical implementation are developed collaboratively by the Elevex Studio team.

5.1 We aim to keep the Website available and functioning correctly but do not guarantee uninterrupted or error-free access. The Website may be unavailable from time to time due to maintenance, updates, or factors outside our control, including third-party hosting outages.

5.2 To the fullest extent permitted by law, we exclude all warranties, express or implied, regarding the Website's availability, accuracy, or fitness for a particular purpose, except for any consumer guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)).

6.1 To the fullest extent permitted by law, Elevex Studio is not liable for any indirect, consequential, incidental, or economic loss arising from your use of, or inability to use, the Website.

6.2 This limitation does not apply to, and nothing in these Terms excludes, restricts, or modifies, any guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.

6.3 Information on the Website (including pricing indications, timelines, and performance claims such as Lighthouse score targets) is general in nature and does not constitute a binding offer. All binding terms for paid services are set out exclusively in a signed Quote and Client Agreement.

The Website may contain links to third-party websites (e.g. social media platforms, hosting providers, live client/demo project links). We are not responsible for the content, accuracy, or practices of any third-party website and including a link does not imply endorsement. Use of any third-party website is at your own risk and subject to that website's own terms.

8.1 Where the Website includes an enquiry or contact form, submitting it does not create a binding contract. It is treated as a Project Brief submission and is for scoping purposes only.

8.2 Information submitted through enquiry forms is handled in accordance with our Privacy Policy.

We may update these Terms from time to time to reflect changes in our services or applicable law. The current version will always be available at elevex.biz/terms with the effective date displayed above. Continued use of the Website following an update constitutes acceptance of the revised Terms.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Ryan Patrick Telley, the operator of this Website and registered sole trader (ABN: 27 958 310 326), is a minor under the Minors (Property and Contracts) Act 1970 (NSW). The Website and associated business are operated lawfully in the course of a registered trade or business.
